Every year in the United
States, there are over 100,000 pedestrians injured by
automobiles. More than half of these will be killed.
This is obviously a very serious problem, especially for
young school aged children, as many pedestrian related
deaths occur between 3:00 pm and 4:00 pm, when many
school children are on their way home from school.
Children and the elderly are most at risk of injury or
death in an automobile-pedestrian accident.
Automobile-pedestrian accidents cause broken bones,
spine injuries, permanent disability, head injuries,
brain injuries, disfigurement, emotional distress and
far too often, death. If you have been injured or harmed
in a pedestrian accident or if you are the relative of
someone killed as the result of a pedestrian accident
caused by a negligent driver, you should seek competent
legal advice as soon as possible.
In cases such as these, insurance companies almost
always blame the pedestrian for the cause of the
accident. Some of these accidents are caused by the
pedestrian, such as the child running into the road to
retrieve a bouncing ball. However, the vast majority of
cases result from the negligence of the automobile
driver. Many times the driver is pre-occupied, speeding,
under the influence of alcohol or is simply not paying
attention. It is generally the driver of the vehicle
that is responsible for the accident. Please don’t be
fooled by an insurance claims adjustor or a defense
attorney trying to convince you that you or a loved one
are the cause of the accident. These type of cases need
to be taken to an attorney who is experienced in
handling pedestrian automobile accidents. These truly
are unique personal injury cases.
In the majority of these
cases, the insurance companies try to blame the
pedestrian for the accident. While a pedestrian
generally must adhere to the law, it is certainly just
as important that a driver obey all traffic rules and
regulations, as well. Utah law is relatively clear that
a driver has an obligation to see what is there. As
such, a defense that “I simply didn’t see her,” is
typically insufficient to support a denial of such an
injury claim. |

Because pedestrians are
killed or disabled at a much higher rate than any other
type of automobile collision, you need an attorney who
has the skill and ability to pursue such a claim. Here
at Aaron J. Prisbrey, P.C., we have handled numerous
cases involving disability. We also have handled
numerous pedestrian cases and understand the dynamics of
an automobile/pedestrian accident and the relative
forces of the impact.
We have developed strategies and procedures to ensure
the best resolution possible in your automobile/
pedestrian case. We work with you, your physicians and
the insurance company to obtain the most appropriate
settlement possible in your case. If such a settlement
is not offered by the insurance company, we will prepare
your case in the most expeditious fashion to present
your case to a jury trial.
Mr. Prisbrey has written several books relating to
accident cases. His first book, Ten Essential Skills
Your Injury Attorney Must Have, is available free of
charge to Utah accident victims only. (This book can be
obtained through the website or calling our automated
toll-free number.) The book focuses on some of the
complexities of injury cases including what to look for
in an experienced personal injury attorney. The book is
presented in a sometimes humorous, straightforward way.
It is a very practical guide for injury accident
victims. It is available free of charge only to Utah
accident victims, through the toll-free number or by
completing the form on this site.
